Terms and Conditions of Sale
1. Purpose and scope
These Terms and Conditions of Sale ("Terms") govern the supply by Drovane Portfolio, a French sole proprietorship (micro-entreprise) registered under SIRET 984 968 461 00025, with registered address at 155 avenue de Wagram, 75017 Paris, France, of the subscription service available at drovaneportfolio.com (the "Service") to any individual or legal entity subscribing to it (the "Customer").
Subscribing to the Service implies full and unreserved acceptance of these Terms, available at any time on the website.
2. Description of the Service
Drovane Portfolio publishes a weekly crypto-asset portfolio allocation, built from a quantitative cross-sectional momentum strategy (inverse-volatility weighting, market-regime-conditional overlay).
The Service provides general information and an allocation recommendation, presented for informational purposes only. It does not include:
- custody or holding of the Customer's assets,
- execution of orders on the Customer's behalf on any exchange platform,
- personalized investment advice within the meaning of applicable regulations (see Section 7, "Risk Warning").
Two plans are offered:
- Free: access to the allocation with a 48-hour delay.
- Pro (paid subscription): real-time access to the allocation as soon as it is published, with no delay.
3. Registration and user account
Access to the Service requires creating an account (email address and password). The Customer guarantees the accuracy of the information provided upon registration and undertakes to keep it up to date.
The Customer is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account. Any suspected unauthorized use must be reported immediately to contact@drovaneportfolio.com.
4. Pricing, subscriptions and payment terms
| Plan | Price | Billing |
|---|---|---|
| Pro monthly | €29 | Billed monthly |
| Pro annual | €290 | Billed annually |
Prices are stated in euros. As Drovane Portfolio operates under the French VAT exemption scheme for small businesses ("franchise en base de TVA", Article 293 B of the French Tax Code), no VAT applies to Customers residing in France; VAT treatment for Customers residing outside France depends on their country of residence.
Payment is made by credit card via the payment processor Stripe, which securely handles payment data; Drovane Portfolio has no access to any of the Customer's banking data. Payment is automatically charged at each billing cycle (monthly or annual) as long as the subscription is not cancelled.
In the event of payment failure, access to the Pro plan may be suspended until the situation is resolved.
5. Term, automatic renewal and cancellation
The Pro subscription is entered into for a one-month or one-year term depending on the plan chosen, and automatically renews for an identical term unless cancelled by the Customer before the renewal date.
The Customer may cancel their subscription at any time from their account (subscription management portal), without justification or penalty. Cancellation takes effect at the end of the period already paid for; no pro-rata refund is issued for the current period, except as provided in Section 6.
6. Right of withdrawal
In accordance with French consumer law (Articles L.221-18 et seq. of the Consumer Code), a Customer who is a consumer has 14 days from subscription to exercise their right of withdrawal, without having to provide a reason.
However, since this is digital content supplied immediately (real-time access to the allocation upon subscription), the Customer acknowledges, by making payment, expressly waiving their right of withdrawal once performance of the Service has begun with their prior consent, in accordance with Article L.221-28 13° of the French Consumer Code.
7. Risk warning and no investment advice
Crypto-assets are highly volatile and speculative instruments. Their value may fluctuate significantly, and the Customer may lose all or part of the capital invested, and more where leverage is used (see below).
Leverage. The published strategy uses leverage: its exposure is not capped and, in the backtest, it reached about 2.4 times capital. Leverage amplifies losses as well as gains: the Customer may lose more than their initial investment. On a margin account, a sharp drop can trigger the liquidation of positions, before stop orders even execute. Borrowing costs and execution slippage are not included in the displayed performance. Replicating the allocation beyond 100% of capital requires an account allowing margin or derivatives, the use of which is the Customer's sole decision.
The allocations published by Drovane Portfolio result from the systematic application of a quantitative model based on historical data. They do not constitute personalized investment advice, a recommendation to buy or sell, or any guarantee of future performance. Past performance, including backtest results, is not indicative of future results.
Drovane Portfolio is not registered or licensed as a digital asset service provider (PSAN) with the French financial markets authority (AMF), and does not carry out any regulated investment advisory activity. The Customer remains solely responsible for their investment decisions and for executing their own orders, on the platform of their choice.
8. Limitation of liability
Drovane Portfolio uses all reasonable means to ensure the availability and reliability of the Service, without any obligation of result. Drovane Portfolio shall not be liable for:
- financial losses resulting from the Customer's investment decisions,
- interruptions, delays or unavailability of the Service caused by external factors (third-party provider failure, unavailability of a market data API, force majeure),
- consequences of any use of the Service that does not comply with these Terms.
Should Drovane Portfolio's liability be established, it is capped at the total amount paid by the Customer for their subscription over the preceding twelve months.
9. Intellectual property
The website, the Drovane Portfolio brand, the methodology, the algorithms, and all published content (allocations, text, performance data, code) are the exclusive property of Drovane Portfolio or its providers, and are protected under intellectual property law.
The subscription grants the Customer a personal, non-exclusive right to use the information provided, for strictly private purposes. Any reproduction, redistribution or resale of the allocations or data to third parties is prohibited without prior written consent.
10. Personal data
Personal data collected (email, account data, payment data processed by Stripe) is necessary to manage the account and subscription. It is processed in accordance with the General Data Protection Regulation (GDPR) and French data protection law.
The Customer has the right to access, rectify, erase and port their data, exercisable by contacting contact@drovaneportfolio.com. For details on processing, retention periods and recipients, please refer to the website's Privacy Policy.
11. Complaints and mediation
Any complaint may be sent to contact@drovaneportfolio.com. Drovane Portfolio undertakes to respond within a reasonable time.
In accordance with Articles L.616-1 et seq. of the French Consumer Code, if a dispute is not resolved amicably, a Customer who is a consumer may refer the matter free of charge to a consumer mediator. The competent consumer mediator is currently being designated; their contact details will be published on this page once selected.
12. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent French courts will be those of the defendant's place of residence, or any other court designated under the rules of jurisdiction applicable to consumer law.
13. Amendments to these Terms
Drovane Portfolio reserves the right to amend these Terms at any time. The Terms applicable are those in force on the date of subscription or renewal. Any material change will be notified to the Customer by email before it takes effect.
Current version. These Terms, updated to add the leverage warning (Section 7), apply from 6 October 2026 to new subscriptions, and from their next renewal to subscriptions in progress. A Customer who does not accept them may cancel their subscription at any time, under the conditions of Section 5.
